WAY31 Boutique (“We,” “Us,” “Our”) offers a mobile messaging program (“Program”), which you agree to use and participate in under these Mobile Messaging Terms and Conditions and our Privacy Policy (“Agreement”).

By opting in or participating in our Program, you agree to these terms, including resolving any disputes through binding individual arbitration as outlined in the Dispute Resolution section below.

This Agreement applies only to the Program and does not alter other Terms and Conditions or Privacy Policies that may apply to your interactions with WAY31 Boutique.

User Opt-In

You may opt in to receive mobile messages from WAY31 Boutique through online or app-based forms.

By joining, you agree to receive autodialed or prerecorded marketing messages to the phone number you provide. Consent is not required to make a purchase. Message and data rates may apply. Message frequency varies.

User Opt-Out

You may opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from us. You may receive one confirmation message acknowledging your request.

Please note: variations of these commands or verbal requests cannot be processed as valid opt-outs.

Program Description

Users who join may receive updates related to marketing, promotions, payment, delivery, and sales of clothing, apparel, and accessories. Messages may also include checkout reminders.

Message and data rates may apply. Frequency of messages will vary. The Program may include recurring messages based on your activity with WAY31 Boutique.

MMS Disclosure

If your mobile device does not support MMS messaging, the Program will send SMS (text) messages instead.

Disclaimer of Warranty

The Program is offered on an “as-is” basis and may not always be available. We are not responsible for delayed or failed message delivery, which depends on your wireless carrier. Carriers are not liable for delayed or undelivered messages.

Participant Requirements

To participate, you must:

  • Own a mobile device capable of two-way messaging
  • Subscribe to a participating carrier’s messaging plan
    Not all carriers or devices support these services.

Age Restriction

You may not use or engage with this Program if you are under 13 years of age.

If you are between 13 and 18, you must have parental or guardian permission.

By using this Program, you confirm that you meet these age requirements and are legally allowed to participate in your jurisdiction.

Prohibited Content

You agree not to send any content that is:

  • Fraudulent, harassing, or defamatory
  • Obscene, violent, hateful, or discriminatory
  • In violation of privacy, HIPAA, or other laws
  • Containing harmful code (viruses, Trojan horses, etc.)
  • Unlawful or otherwise restricted by applicable law

Dispute Resolution

If a dispute arises between you and WAY31 Boutique, or between you and any third-party service provider acting on our behalf, it will be resolved by binding arbitration in Baton Rouge, Louisiana, before a single arbitrator.

The arbitration will follow the Commercial Arbitration Rules of the American Arbitration Association (AAA).

The arbitrator’s decision will be final and binding.

Each party will bear its own costs unless the arbitrator determines otherwise.

No punitive damages or class actions are permitted, and each claim must be brought individually.

If a court proceeding is required, both parties waive the right to a jury trial.

Louisiana Law

This Agreement is governed by the laws of the State of Louisiana, without regard to conflict of law principles.

Miscellaneous

You represent that you have the authority to agree to these terms.

Failure by either party to enforce any provision shall not constitute a waiver.

If any part of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in effect.

We may update these Terms and Conditions periodically. It is your responsibility to review this Agreement for changes. Continued participation constitutes acceptance of any updated terms.

All purchases made through WAY31 Boutique are final sale.

We do not accept returns, exchanges, or cancellations once an order has been placed.

Damaged or Incorrect Items

If you receive an incorrect or damaged item, please contact us within 3 business days of receiving your order at frankeya@way31.com.

Please include your order number, photos of the item, and a brief description of the issue.

Reports made after 3 business days will not be eligible for review.

Sizing & Fit

We proudly serve women in sizes Small–6X. Please review our size charts carefully before completing your purchase.

Refunds

Refunds are only issued if a verified damaged or incorrect item cannot be replaced.
